Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Rindexa search engine API and related services ("Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Definitions

  • "Rindexa", "we", "us": refers to the operator of the Rindexa platform.
  • "User", "you": refers to any individual or legal entity that registers for or uses the Service.
  • "Tenant": a logically isolated account within Rindexa identified by a unique tenant_id.
  • "API Key": the credential provided upon registration to authenticate requests to the Service.
  • "Content": any data, documents, text, or information you index, store, or transmit via the Service.

2. Eligibility and Account Registration

To use the Service, you must:

  • Be at least 16 years of age (or the age of digital consent in your jurisdiction).
  • Provide accurate, complete, and current registration information (email, tenant ID, password).
  • Be authorized to bind the organization you represent, if applicable.

You are solely responsible for maintaining the confidentiality of your credentials (password and API key) and for all activities that occur under your account. You must notify us immediately at support@rindexa.com if you suspect unauthorized access.

3. Description of the Service

Rindexa provides a sub-millisecond, multi-tenant search engine accessible via a REST API. The Service allows you to index documents, execute full-text search queries, manage API keys, and integrate search functionality into your applications. The Service is hosted on infrastructure provided by third-party providers (see our Privacy Policy for details).

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right (including intellectual property and data protection laws).
  • Index, store, or transmit unlawful, defamatory, harassing, or otherwise objectionable content.
  • Attempt to gain unauthorized access to other tenants' data or to any system or network.
  • Interfere with or disrupt the Service, including by circumventing rate limits or security measures.
  • Use the Service for any purpose that is fraudulent, deceptive, or harmful.
  • Store special categories of personal data (Article 9 GDPR) without appropriate legal safeguards.

5. Your Content and Data

You retain all ownership rights in your Content. By using the Service, you grant Rindexa a limited, non-exclusive license to process, index, store, and serve your Content solely for the purpose of providing the Service.

You are responsible for ensuring that your Content complies with applicable laws, including the GDPR if your Content includes personal data of EU/EEA residents. In such cases, you act as the data controller and Rindexa acts as a data processor under the terms of a Data Processing Agreement (DPA), available upon request at privacy@rindexa.com.

6. Service Plans and Pricing

The Service is offered under different plans with varying usage limits:

  • Developer (Free): Up to 10,000 documents and 100,000 searches per month. No credit card required.
  • Premium plans: Additional capacity and features. Pricing details will be published when available.

We reserve the right to modify pricing with at least 30 days' prior notice. Changes will not affect your current billing period.

7. API Usage and Rate Limits

The Service enforces rate limits to ensure fair usage and system stability. Exceeding rate limits will result in 429 Too Many Requests responses. We reserve the right to throttle or suspend accounts that consistently abuse the Service or exceed their plan limits.

8. Intellectual Property

The Service, its design, codebase, algorithms, trademarks, and all related intellectual property remain the exclusive property of Rindexa. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

9. Service Availability and Warranties

The Service is provided on an "as is" and "as available" basis. While we strive for high availability and performance, we do not guarantee:

  • Uninterrupted, error-free, or secure access to the Service.
  • That the Service will meet all your specific requirements.
  • Specific response times or latency thresholds in all circumstances.

We may perform scheduled maintenance with reasonable advance notice. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law (including EU consumer protection rules), Rindexa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability under these Terms shall not exceed the amounts paid by you (if any) for the Service during the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability for death, personal injury, or fraud.

11. Termination

You may terminate your account at any time by contacting us at support@rindexa.com. We may suspend or terminate your access if:

  • You breach any provision of these Terms.
  • Your use of the Service poses a security risk or may cause harm to other users.
  • Required by law or a regulatory authority.

Upon termination, your right to use the Service ceases immediately. Your indexed data will be deleted within 30 days, in accordance with our Privacy Policy. You may request a data export before account closure.

12. Communications

By creating an account, you agree to receive transactional communications related to the Service (e.g., account confirmation, security alerts, service changes). These are necessary for the performance of the contract and do not require separate consent under GDPR Article 6(1)(b).

If you opt in during registration, we may also send you product updates, tips, and promotional content via email. You can withdraw this consent at any time by using the unsubscribe link included in every marketing email, or by contacting us at support@rindexa.com. This is in compliance with the ePrivacy Directive (2002/58/EC) and GDPR Article 7.

13. Data Protection

We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the ePrivacy Directive 2002/58/EC. For full details on how we collect, use, store, and protect your personal data, please refer to our Privacy Policy. Where you act as a data controller indexing personal data of third parties through the Service, a Data Processing Agreement (DPA) is available upon request.

14. Modifications to These Terms

We reserve the right to update these Terms at any time. Material changes will be notified at least 30 days in advance via the email address associated with your account and/or through a prominent notice on our website. Continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree with the revised Terms, you must cease using the Service and may request account deletion.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union and the Member State where Rindexa is established, without regard to conflict of law principles.

Any disputes arising from these Terms shall first be attempted to be resolved amicably. If no resolution is reached within 30 days, disputes shall be submitted to the competent courts. If you are a consumer in the EU, you retain the right to bring proceedings in the courts of your country of residence, and you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
